Terms of Service

1. Parties

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and Kel-Kel Global LLC operating under the brand "Aidos Company" ("Aidos Company", "we", "us", "our").

By using the Service you confirm that you have read, understood and agreed to these Terms.

2. The Service

Aidos Company provides a platform that lets businesses deploy AI-powered conversational assistants (chatbots and AI agents) on messaging channels such as Instagram and WhatsApp, and on the Customer's own websites. The Service includes:

  • Integration with Meta Platforms (Instagram, WhatsApp) and other messaging providers.
  • AI response generation via large language model (LLM) providers (currently OpenAI gpt-5-mini; we reserve the right to add or change providers).
  • Workflow automation (currently powered by n8n Cloud).
  • Knowledge-base ingestion (RAG) and human-handoff features.
  • A customer dashboard, analytics and billing (rolled out in phases).

We may change the features of the Service at any time. We will use reasonable efforts to notify Customers of material changes.

3. Eligibility and accounts

You must be at least 18 years old and legally capable of entering into a contract to use the Service. If you sign up on behalf of a legal entity, you confirm that you are authorized to bind that entity.

You are responsible for keeping your account credentials confidential. You must notify us immediately at office@the-aidos.com about any unauthorized use of your account.

4. Customer obligations

You agree to:

  • Provide accurate information when signing up and keep it up to date.
  • Use the Service in compliance with applicable laws of the Kyrgyz Republic and the laws of any other jurisdiction where you operate.
  • Comply with the Meta Platform Terms, the Instagram Platform Policy and any other third-party rules that apply to channels you connect.
  • Obtain all necessary consents from your end users before sending them messages via our Service.
  • Not use the Service to send spam, scams, malware, hate speech, sexual content involving minors, content that infringes intellectual property rights, or any other unlawful content.
  • Not attempt to reverse-engineer, decompile, or bypass the security of the Service.

5. Acceptable use

The following are strictly prohibited:

  • Mass unsolicited messaging in violation of Meta's policies.
  • Impersonation of other persons or organizations.
  • Collection of personal data of end users beyond what is necessary to provide your own service to them.
  • Any activity that could damage the reputation of Aidos Company, Meta, or any third-party platform we integrate with.

We may suspend or terminate your account immediately if we reasonably believe you violate this section.

6. Fees and payment

Fees for the Service are described on https://the-aidos.com or in a separate written agreement. Unless agreed otherwise:

  • Subscription fees are billed monthly in advance.
  • Setup fees are billed once, upon signing.
  • All amounts are stated exclusive of any applicable taxes; you are responsible for any taxes due in your jurisdiction.
  • Late payments may result in suspension of the Service.

Refunds are at our discretion and are not granted for partially used billing periods unless required by law.

7. Third-party services

The Service relies on third-party platforms (Meta, OpenAI, n8n, Google Cloud, payment providers, etc.). We are not responsible for the availability, performance or actions of these third parties. Your use of those platforms is also governed by their own terms of service.

8. Intellectual property

We retain all rights, title and interest in and to the Service, including all software, models, templates, documentation, and trademarks.

You retain ownership of your content (messages, knowledge-base documents, branding) that you upload to the Service. You grant us a worldwide, non-exclusive, royalty-free license to use, store, process and display your content solely to provide and improve the Service.

9. AI-generated output

The Service uses AI to generate responses. AI output:

  • May be inaccurate, incomplete, biased or unsafe.
  • Is not a substitute for professional advice (legal, medical, financial, etc.).
  • Is provided "as is" without warranty of any kind.

You are responsible for reviewing AI output before sending it to your end users where the use case requires it, and for configuring human-handoff flows for sensitive scenarios.

10. Confidentiality

Each party will keep the other party's confidential information (including business plans, customer lists, and technical details) confidential and use it only to perform this contract.

11. Data protection

Our processing of personal data is governed by our Privacy Policy at https://the-aidos.com/en/privacy. For business customers, a separate Data Processing Agreement (DPA) is available upon request at office@the-aidos.com.

12. Service level and availability

We aim to provide the Service with reasonable uptime but we do not guarantee uninterrupted availability. Scheduled maintenance, third-party outages, and force majeure events may cause downtime.

13. Warranties and disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

14. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, consequential, incidental, special, or punitive damages.
  • Our total aggregate liability under these Terms is limited to the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or USD 100, whichever is greater.

15. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, damage or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your content, (c) your use of the Service in violation of any law or third-party rights.

16. Term and termination

These Terms are effective until terminated. You may terminate by cancelling your subscription at any time. We may suspend or terminate the Service if you breach these Terms, fail to pay, or for legal/regulatory reasons.

Upon termination, your right to use the Service ends and we will delete your data in accordance with our Privacy Policy.

17. Governing law and disputes

These Terms are governed by the laws of the Kyrgyz Republic. Any dispute will be resolved by the competent courts of the city of Osh, Kyrgyz Republic, unless the parties agree to arbitration.

18. Changes

We may update these Terms from time to time. The current version is always available at https://the-aidos.com/en/terms. Material changes will be communicated to Customers by email or in-product notice. Continued use of the Service after a change means you accept the new Terms.
